These Terms & Conditions (“Terms”) govern your access to and use of destinycup.com (the “Site”) and your purchases from us. By using the Site or placing an order, you agree to these Terms.

1. Eligibility & Scope

  • The Site is intended for customers 18+ located in Europe.

  • Business purchases (B2B) are available on request; different terms may apply.

  • These Terms apply in addition to your statutory consumer rights under applicable law.

2. Products & Content

  • We design and sell laser-engraved stainless-steel tumblers and related accessories.

  • We do our best to display colors and artwork accurately; however, minor variations may occur depending on device settings and manufacturing tolerances.

  • Care/use instructions may accompany the product; please follow them to maintain finish and longevity.

3. Prices, Taxes & Payment

  • Prices are shown in EUR (€) and include or exclude VAT according to the rules displayed at checkout.

  • We reserve the right to update prices at any time before you place an order.

  • Payments are processed securely via Stripe (cards and available local methods). We do not store full card numbers.

4. Ordering & Contract Formation

  • After you place an order, you will receive an order confirmation email. This confirms we received your order, not that it is accepted.

  • A binding contract is formed when we dispatch the goods and send a shipping confirmation.

  • We may refuse or cancel an order (e.g., suspected fraud, incorrect price, lack of stock). Any payment captured will be refunded.

5. Shipping & Delivery

  • We ship from Bucharest, Romania across Europe.

  • Flat rate: €12 per order (standard service).

  • Typical delivery times: EU 3–7 business days, UK/CH/NO/IS 4–9 business days after dispatch.

  • You’ll receive a tracking link once shipped. Delivery times are estimates and may vary due to carrier delays or peak seasons.

6. Right of Withdrawal (EU) & Returns

  • EU consumers have a 14-day right of withdrawal from delivery, without giving any reason (exceptions apply by law).

  • Our store policy is 30 days for returns from delivery; this does not reduce your 14-day statutory right.

  • To be eligible, items must be unused, in the same condition, and in original packaging.

  • Exceptions / non-returnable items:

    • Personalized/engraved items (including custom artwork)

    • Used drinkware or items showing wear, washing, stickers/ink applied

    • Gift cards and downloadable products

    • Certain health/personal care items

  • To start a return: email destinycup.com@gmail.com with your order number and reason (include photos for damaged/defective items).

  • Return address (after authorization): Destiny Cup SRL — Destiny Cup Returns, Str. Nerva Traian 9, Bucharest, Romania.

  • You are responsible for return shipping costs; shipping fees are non-refundable. We recommend a trackable service.

7. Refunds & Exchanges

  • Once we receive and inspect your return, we’ll notify you of approval or rejection.

  • Approved refunds are issued to your original payment method via Stripe within 7–10 business days (bank timings may vary).

8. Delivery Issues & Risk

  • Risk of loss passes to you upon delivery at the address provided.

  • If tracking shows no movement for 7+ days or the parcel arrives damaged, contact us promptly with photos.

  • If a parcel is returned due to incorrect address or failed delivery attempts, we can reship (new shipping fee applies) or refund the product price (shipping non-refundable).

9. Warranty & Conformity

  • We warrant that products conform to their description at delivery and are free from material defects.

  • This warranty does not cover normal wear, misuse, improper care, or modifications.

  • Your statutory consumer rights remain unaffected.

10. Promotions & Discount Codes

  • Promotional offers are valid for the stated period and may be subject to additional terms.

  • Only one discount code can typically be used per order, unless otherwise stated.

  • We may modify or withdraw promotions at any time.

11. Reviews & User Content

  • If you post reviews, photos, or comments, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content on the Site and marketing channels.

  • Do not post unlawful, infringing, offensive, or misleading content. We may remove content that violates these rules.

12. Intellectual Property

  • All Site content, designs, graphics, text, and trademarks (including “Destiny Cup” and “destinycup.com”) are owned by or licensed to Destiny Cup SRL.

  • You may not copy, distribute, or create derivative works without prior written consent.

13. Prohibited Use

You agree not to:

  • use the Site for unlawful purposes,

  • interfere with Site security or operation,

  • scrape, reverse-engineer, or copy content beyond normal personal use,

  • place fraudulent orders.

14. Privacy & Cookies

  • We process personal data according to our Privacy Policy (GDPR-compliant).

15. Limitation of Liability

  • We are not liable for indirect, incidental, special, or consequential damages, loss of profit, data, or goodwill, except where liability cannot be excluded under applicable law.

  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under law.

16. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., strikes, carrier delays, natural events, acts of authorities, outages).

17. Changes to the Terms

We may update these Terms from time to time. The latest version is posted on the Site with the “Last updated” date. Continued use of the Site after changes constitutes acceptance.

18. Governing Law & Disputes

  • These Terms are governed by the laws of Romania and applicable EU consumer law.

  • We aim to resolve issues amicably. EU consumers may use the EU Online Dispute Resolution (ODR) platform in addition to contacting us directly.

  • Romanian courts will have jurisdiction where local law permits, without prejudice to any mandatory consumer protections in your country of residence.
